
Desert Vacation Rentals (hereinafter “we”) and the Renting Party (hereinafter “you”) agree to the following Terms & Conditions
Verification of acceptance is required to complete your reservation. When booking on-line, the terms and conditions acceptance box must be checked before the reservation process can be completed. If you have any questions regarding these terms and conditions, contact one of our reservation staff during normal working hours at 800-797-8428.
Responsible Party/Guest
All fees, charges, and applicable taxes associated with the property rental are the responsibility of the renting party. The Guest identified above is an adult and will be an occupant of the unit during the entire reserved period. Other occupants may be family members, friends or responsible adults; any Guests under the age of 25 must be accompanied by an adult. Access to the unit will be denied to anyone who is not a registered Guest. Use of the premises will be denied to persons not falling within the foregoing categories, violation will result in immediate expulsion from the unit without refund. Violation of any Guest policies will also result in immediate eviction with no refund.
Change in the Number of Guests/Conduct of Guests
Please inform us of any changes in the number of Guests before your arrival. Unless you’ve received written permission from Desert Vacation Rentals, the unit is not for gatherings at any time of anyone except those who have paid to stay there. There are absolutely no parties permitted. If there is evidence of a party, excessive noise, music, or illegal activity Guest will be asked to vacate the premises, no refund given, and a fee of $500 will be charged to the Guests card on file. This fee is in addition to any additional cleaning, replacement cost of broken items, and repairs needed resulting from violation of this policy.
Check In / Check Out
Your unit will be available to you anytime after 4:00 pm on the date of your arrival. Guest departure time is 10:00 am; your prompt checkout is appreciated so we can prepare the unit for our next guests. It is imperative that you follow these check and in and out times. An early arrival and/or later departure time may be possible but must be requested and granted one week prior to arrival in writing. Please check with us if you require either. Without written permission to arrive early or depart late, the following fees will be assessed and charged to Guest’s card on file: In the event that a guest enters the unit before 4:00 pm on their scheduled date of arrival guest will be charged $1 per minute prior to 4:00pm. Guest will be billed $1 per minute they remain in the unit past their 11:00 am check out time on the date of departure.
Payment by Check
If the Guest pays by check rather then credit card, and the check is returned for NSF there will be a $50.00 service charge. Keys will not be issued until the check has successfully cleared the bank. Checks should be made payable to Desert Vacation Rentals.
Booking Confirmation & Rental Payment
Reservations booked 45 days or more in advance of the rental start date are confirmed when one half of the total rental fee is received; the remaining balance is due 45 days before occupancy. Reservations made within 45 days of the arrival date are confirmed on receipt of the entire rental fee, security deposit or optional waiver and any additional charges related to your rental. We accept payment by Visa, Mastercard, cashier’s check, or personal checks if received at least 45 days prior to arrival. Once full payment has been made and the contract signed and returned to Desert Vacation Rentals you will be e-mailed a reservation letter detailing driving directions, how to obtain access to the unit, and some useful information about the unit you are renting.
Pricing
Reservations are confirmed at the rates in effect on the date the booking is made. We reserve the right to correct oversights, omissions, and clerical errors. In the event an adjustment of this nature increases the cost of your booking, you will be given the option to accept the revised reservation or terminate it with no penalty.
Cancellations/Travel Insurance
If you cancel your reservation at any time, for any reason, it may not be possible to re-book the reserved home; therefore, pre-paid rents are not refundable. However, if the home does re-book for the same dates, same length of stay, at the same or greater rental rate, 90% of your prepaid rent deposit is refundable, less a $55 booking fee, within fourteen (14) days after the replacement booking has paid in full. Security Deposits or Limited Damage Waiver payments are fully refundable if the reservation is cancelled prior to occupancy.
Because unexpected events can impact your travel plans, we recommend that you protect your vacation investment by purchasing travel insurance. This coverage is offered for your convenience when the rental is being booked. The conditions of coverage are detailed separately in the policy of the insurance carrier and should be thoroughly reviewed prior to purchase.
On the Rare occasion or event that the Agent is unable to deliver the unit reserved under this agreement because of fire, eminent domain, act of nature, double booking, delay in construction or any other reason whatsoever, Guest hereby agrees that Agent’s sole liability as a result of these conditions is a full refund of all monies previously tendered by Guest. Desert Vacation Rentals will make every effort to provide you with equal accommodation at the same rental rate. If we are unable to do so, or if you do not accept a provided alternative guest expressly acknowledges that in no event shall Agent be held liable for any consequential.
Property Suitability
Review all property amenities, specifications and unique characteristics, including environmental conditions, to verify that the home you have selected will be suitable prior to booking. Private homes may be constructed with unusual features, limited accessibility, or be sited amidst potentially dangerous conditions. Guests with mobility challenges or those traveling with children are specifically advised to discuss concerns or requirements with our reservation department as you will not be able to change homes upon arrival.
Key Return
If all provided keys are not returned at check-out, concerns for property security make it necessary for us to immediately re-key the home. You will be charged for the cost of this emergency service.
Pets
Some properties allow pet stays, subject to specific approval, supplemental daily fees and use restrictions. The presence of undeclared or unauthorized pets in any home will result in a $500 penalty, as well as possible eviction and forfeiture of pre-paid rents. We do not guarantee that any home is free of pet dander or other pet conditions even when pets are not accepted as the property owner may have pets in the home when they are in residence Additions of pets will require, if approved a $500.00 deposits and a pet fee of $150.00.
Smoking Prohibited
Smoking is absolutely prohibited in or around the unit. If there is any tobacco smell in the unit there will be a $500 fee charged to Guest's credit card, as well as any additional associated costs to rid the unit of smoke smell and damage. Cleaning & Housekeeping
Each unit will be inspected, sanitized and cleaned before your arrival, the rental fee you have paid will provide for normal cleaning so that you can enjoy your stay up to the last moment. Housekeeping services are not provided with your rental. You are expected to leave the unit in the same general condition that you received it by making sure dishes are cleaned and put away, appliances left clean, perishable food items removed from the refrigerator and all items and furniture returned to their original location. The unit should be generally picked up and ready to be cleaned and sanitized for the next Guest. If additional cleaning is required you will be charged $50 an hour with a 1 hour minimum; additional cleaning is considered anything beyond laundering linens and towels, changing beds, dusting, vacuuming, cleaning bathrooms, and putting away clean dishes. If additional cleaning requires the use of an outside vendor (i.e. carpet cleaning due to spills on carpet or upholstery) Guest will be charged the cost of that service plus a 20% administrative fee. A guideline is posted in each unit in the Unit Notebook.
Security of the Unit
When you rent the unit, you assume responsibility for it and its contents, as well as any of your personal property in the unit during your stay. Always lock the doors and windows when you leave and leave outside lights on. Lost or missing keys, key cards, and garage door openers will result in replacement fees ranging from $50-$100 per item. The keycodes are changed on a regular basis for security.
Risks/Safety
Children are welcome, however, there may be conditions in and around the unit that may pose hazards to them, as well as to adults. Desert Vacation Rentals does not assume any liability or responsibility for any injuries occurring during your stay with us. Children must be supervised at all times. Candles are not allowed due to fire danger.
Repairs
Please call Desert Vacation Rentals at 800-797-8428 to inform us of any needed repairs, we will address your concerns as soon as possible. No refunds will be issued for malfunctioning equipment. All properties have a home warrantee company assigned to them See HOME BOOK for emergencies.
Telephones
Telephones may be used to make as many local calls as you wish at no additional charge. YOU MUST USE A PHONE CALLING CARD TO MAKE LONG DISTANCE TELEPHONE CALLS. Should long distance calls be inadvertently charged to the unit Desert Vacation Rentals will charge the Guest’s credit card number for such charges.
Hold Harmless
Desert Vacation Rentals does not assume any liability for loss, damage or injury to Guests, their invitees or their personal property. Desert Vacation Rentals does not accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, electricity or plumbing, nor will Desert Vacation Rentals accept liability for any loss or damage caused by Guests negligent or intentional conduct, weather conditions, natural disasters, acts of God, or other reasons beyond its control.
Locked Areas; Hot Tubs/Pools and Patios
Certain units may have locked closets designated for private use which are reserved for the exclusive use of the Owner and/or Agent. Those areas will not be available for the use of the Guest. Guest hereby acknowledges that if the unit they have reserved includes a hot tub and Pools, they are fully aware that the hot tub or Pools and surrounding patio/deck can be dangerous, that the deck/patio can be slippery when wet, and that injury is likely to occur to anyone who is not careful. Guests should observe and adhere to all rules and policies as posted at the property. The undersigned Guest accepts and assumes all risks involved in or related to the use of the Pool, hot tub and patio areas.
Security Deposit
The normal security deposit required is $1,000 (see also “Limited Damage Waiver, below), payable by Mastercard, Visa, or cashier’s check. A personal check will be accepted if it is received more than 45 days prior to occupancy. If you have paid the full security deposit, it will be refunded within fourteen (14) days following your stay if no damage is sustained and all other financial obligations have been met. However, you will be responsible for any expenses/invoices presented subsequent to the return of your deposit.
Limited Damage Waiver
Rather than post the security deposit as shown above, under certain conditions you may elect to purchase a non-refundable damage waiver. Doing so eliminates you from up to $1,000 of responsibility due to accidental damage or loss to the vacation home. Specific conditions apply and you must agree to those conditions prior to selecting this optional coverage. The Waiver is not an option if you are booking certain homes or booking for stays exceeding thirty days.
